Center to Keep and Bear Arms Sues Washington Over ‘High Capacity’ Magazine Ban

The American People have a natural, constitutionally protected right to choose the self-defense tools they need to protect their lives and loved ones.

To uphold that right, a group of plaintiffs represented by Mountain States Legal Foundation’s Center to Keep and Bear Arms (CKBA) and Cooper & Kirk, PLLC, is suing the State of Washington in federal court. They’re challenging Washington’s ban on the sale, import, distribution, and manufacture of firearm magazines able to hold more than 10 rounds of ammunition—an unconstitutional enactment that threatens life and liberty in the Evergreen State.

On June 3, CKBA’s clients filed their complaint against Washington Attorney General Robert Ferguson in the Western District of Washington, seeking to have the magazine ban declared unconstitutional and to prevent its enforcement. The reason I say that is that the states would definitely have something to say about it should they attempt to do it without state input. So even if the political mass in Washington DC were to receive all the required pre requisites for them to go ahead and amend outside of a constitutional convention, the states would likely call another one to remedy it.

The Constitution affirms our rights, it doesn't grant them.

No law can violate natural rights of free citizens. Laws are supposed to affirm rights not strip them, unless you are otherwise involved in criminal activity that is harmful to society.

Millions of gun owners are not going out and shooting people dead. If they were, we wouldn't be talking. So penalizing gun owners by removing their rights won't do a damn thing to stop school shootings. It will however compel gun owners to defend their God given right to bear arms in the face of criminals who are shooting schools up, for their own protection and the protection of their loved ones.

You can't have our guns because of a few rotten apples. That isn't how this works.
