The kid claimed to be there protecting businesses. Specifically latched on to a group protecting a gas station.

He was not at said businesses when the incident occurred.

Was he agitating is a valid question that should be answered during the trial.

Did his anti-BLM bias bring him there to cause trouble? Did he cross the state border looking for a fight? Again, all good questions that should be answered during the trial.

If you bring a gun to a riot and shoot someone it's a premeditated homicide. That's why police generally aren't armed with deadly weapons while suppressing a riot, if they shoot an unarmed protestor it would be considered an intentional homicide.
