Arguing it as a tax was their last fight. A mere 21 lines devoted to arguing that it was a tax. I think the dissenters got it correct - congress was not mistaken in the choice of words they used - in fact they said "penalty" 18 times. And Roberts defends that by saying he was only correcting their misuse of words - they really meant to say "tax". The supreme court cannot rewrite the legislation and that is exactly what they did.

Firstly, epilepsy drugs are safe and have been used by millions. If this had been an issue, it would have come up in his confirmation hearings because the Democrats really did oppose his appointment to the court and as Chief Justice.

Secondly, in ruling that this law was actually a tax, the court did clarify that it is unconstitutional under the commerce clause of the constitution thereby limiting the scope of that clause which has been used by Congress to justify all sorts of spending.

Ultimately, that will be the biggest effect of the ruling.

The law is badly written, grossly expensive, administratively impossible, and does nothing to actually improve health care or reduce costs. It creates a panel of 15 who will decide just what care patients can have -- in other words, just how health care will be rationed.

Most people want it trashed and replaced with something that is far simpler and actual reforms both the insurance industry and the legal malpractice laws.
