To answer your question. Yes, they can, due to a Supreme Court ruling. Justice Thomas made a comment after the overturning of Roe vs Wade, that Gay Marriage could be overturned the same way. So, this legislation solidifies what should have happened in the first place. The Congress making laws, not the courts.

For me, the government should only be handling civil unions. Leave HOLY matrimony to the church and then register for a legal civil union, if you want the legal protections of the government.
