Because the FIB didn't go back and seize the passports from some new legal action as OP implied. They stole them during the original raid. They were not listed in the search warrant and shouldn't have been removed.

The DOJ now has to return the passports.

But, based on her description of how they willy nilly took whatever they want and the attorney still can't figure out from the stuff they got exactly what was taken.
