I was once very well versed in the Geneva Convention and rules for warfare. Foreign soldiers engaged in a conflict without legal cause would be similar to soldiers out of uniform in a conflict/restricted zone or saboteurs. This means they have zero legal protection--a short trial would not even be required before hanging or being shot.
