Any Illinois landlords here? I have a question...
If a landlord rents out a house, and then a year later the city comes by and notices that the house is not up to code (was a garage before it was remodeled as a house), is the renter entitled to a refund of ALL the rent that's been paid, or just the deposit?

Let me guess it didn't meet the lot spacing requirements so you want $10K on top of it for punitive damages.

I don't know what the violation is.

It's my son who is the renter. The main house caught fire 3 days ago and as a result, the "garage house" where my son and his family live lost power and heat because the utilities are connected to the main house. So they had to find somewhere to stay until the issue was fixed. Today, the landlord told them about the code violation and said he'd let them know by tonight if they can still live there or not.

The night of the fire, people from the red cross told my son and his wife that they would help them with a place to stay, then a couple hours later told them they couldn't find anywhere, which is weird.

So they have been in a hotel since then.

They have 2 small kids, and they don't make much money. Paying for a hotel is using up most of what they do have.

If the landlord says they can't live in their house anymore, they're suddenly homeless through no fault of their own and they're trying to make a plan.

Just looking for helpful info, here.

First of all
Read the lease

It may cover the problem.

If not contact Catholic Charities.

If the lease does not address the issue it would be the landlords responsibility to find a place for them to stay. They paid their rent he owes them a legal place to stay.

The only money they can get back is the money they are owed for the rest of the month they paid rent.

If they paid until the end of February he owes half a month back to them. That money goes for a few days at a hotel.

After that they will have to find a new place to live assuming the landlord gives them their deposit back.

He cannot legally rent a building not up to code because if it burns down with someone in it he is liable.

Bottom line. They should get their half month rent back and their deposit presuming they did not damage the property.

Ask the closest church for help.

Hey Op. I work for the red cross and live in Illinois. Im in Peoria. I was in Chicago last week for a meeting when probably a 3rd of the team left to assist with a 26 family apartment fire on the west side. They absolutely will assist with anything that they can. Please have your son reach back out to the contact that he has and if you need further assistance just let me know.
