They want to grant the government the right to force you to take vaccines, but they realize that will undermine their credibility in light of the uselessness of them of mildness of Covid. They waited too long to decided this case. If they had allowed it a month ago they’d be fine.

On a legal basis, OSHA lacks the authority to mandate. TX injunction spelled this out perfectly. OSHA's regulatory authority is limited to risks in the workplace, the disease is everywhere. Hence the very word "pandemic."

If the disease was a unique risk of a occupation, it would be a slam dunk. Of course the mandate would be limited to that occupation.

On a policy basis (which activists love), everyone is backing off statements of efficacy. 2-3-4 shots all admit it's worthless. And the Court would be affirming a system of shots for this reason, which is clearly not a one-time emergency (ETS), which OSHA also can't do.

Soon, those experts will be admitting it's not safe as well. You can expect people in DC to have more information than the people at CNN who get told to repeat narrative. This is major shift because the affirmation of employer mandates always assumed employer liability. An unsafe gov mandated thing has no bag holders, just millions of damaged/dead Americans without recourse.

I'm not saying we win, I'm just saying their decision would be evidence that they have been compromised as there is no legal or policy rationale for such a decision.

If Libs want this power, they need to pass a law, and stop abusing "emergency" authority. That law would immediately be subject to judicial review and reconciled with the Constitution. I do not see how such a law would be upheld given 1A, 4A, 5A (penalties), 14A.
