Quoting: Coastie Patriot As of Jan. 10, businesses with 100 or more employees were required to ensure that all employees have been fully vaccinated with either two doses of the Pfizer or Moderna vaccines or one dose of Johnson&Johnson’s, and they must provide paid leave to workers getting the vaccine. Businesses included in the mandate must also keep track of workers’ vaccination status via a database, provide employees with their company’s vaccine policy and procedures, and ensure unvaccinated employees wear a mask while indoors. That is the big red line that separates an employer mandate from a gov one. The Court has ruled that employer mandates are Constitutional because they exist within the boundaries of employment contract/law which, among other things, imparts liability on the employer for everything that happens as a condition of employment. Your HR department doesn't determine their civil liability. That is determined by lawyers, judges, and juries. Put it this way: They exist in a climate where if one employee hears something at the water cooler she doesn't like it can be six figures of hurt feelings simply because it happened in the course of employment. Now you have personal, lifetime injury, with the added risk of religious discrimination for all those exemptions they tried to qualify (<-- illegal). This decision matters. A lot. If the Court decides for the gov, employers are effectively relieved of this liability. If they decide for the people, corps are bankrupt. Star |
