Please make your employer aware that you have a religious conflict with the requirement based solely on a deeply held and sincere belief.

I have helped a number of people claim their exemption. OSHA "policies" don't override decades old FEDERAL law.

This is becoming more and more true.

When I started helping people navigate the process it was met with many more issues than as of late.

More and more employers now realize they just want to be "compliant". Approving the exemptions and filing them does keep them compliant and is perhaps even easier on HR departments moving forward than constantly updating jab statuses as the CDC continues to move goal posts and request ever more and more jabs for compliance.

And many should note, IF the SCOTUS has been so corrupted as to allow mandates to go through, you can AND SHOULD make your employer aware of the religious conflict arising from weekly testing as well. Yes it can and has been granted.

It's all up to your discernment and prayer to see how much you want to assert.

This. The Biden mandate is pretty much a rouge for people to 'fight against' - even though most corporations are implementing their own mandates and destroying their workers just the same.

The SCOTUS decision is largeyl irrelevant for the masses.

Same here. My asshole CEO was jizzing himself over the chance to force his minions to take the vax. All emails from HR cited the ETS as the reason but when I backed them into a corner, asking specific questions such as “if ETS is stayed by SCOTUS will the company delay until it is ruled on?” And “if ETs is eventually ruled illegal and or unconstitutional will the company delete any info I upload or enter into the compliance portal?”

I am 100% remote and they don’t care. I’m in sales and I generate over 20x what I cost the company annually. Some colleagues in other tech firms say their companies are allowing remote workers to be untaxed but they still have to answer the questions in the portal. I got jabbed in April so I could go on vacation without hassle but I didn’t want to be forced to disclose my status or “show my papes” to HR or Legal as it’s none of their fucking business.

In their final salvo on the deadline of last Friday, which I could tell came directly from head of legal, they admitted that compliance is now company policy regardless of any decisions by SCOTUS. I have it all in writing and if possible will sue the fuck out of them later if possible for any reason at all.

In the meantime I’ve been an overly loyal employee for 18 years and now my give a shit meter is set to zero. I’m calling in sick this week and maybe next too. Next headhunter that comes along with a good opportunity will get a callback from me. I’ve not looked for a new job in 18 years.

This is not true.

You can make your employer aware of a religious conflict with ANY policy.

BY FEDERAL LAW... They have to either ...

1)Make a reasonable accomodation

or

2)Demonstrate (key word), why an accommodation cannot be made.

A good last line in your letter may be,

"Considering that OSHA will consider you a compliant employer based on any EEOC religious accommodations, I see no reason why a reasonable accommodation cannot be made for me to be dismissed from weekly testing."

Yes. You can raise a Religious objection to jabs, masks, and tests.

OSHA is an agency. And they are attempting to issue "regulation" to your employer.

The Civil Rights act is FEDERAL LAW.

Which one do you think trumps which one?

Re: Got the HR letter re:OSHA mandate this morning. Curious about how this is playing out for others.
The law merely states you need to make your employer aware of the conflict. You aren't requesting an exemption, the law declares you are ALREADY exempt.

They (your employers lawyers) love you mix those terms up but that is NOT what the law says.

The law and section 12 of EEOC guidance clearly states that you do not need to:

1)do it by a date

2)On a certain form

3)Use specific of "magical" words

and lastly

4)That an employer should view your expressing a conflict as GENUINE.

Secondly, the law, the Supreme Court, numerous case laws, and numerous EEOC claims that have BEEN WON are clear. YOUR RELIGION does not need to adhere to an ORGANIZED ONE for the purposes of employment conflicts.

Meaning, a sincerely and deeply held belief BY YOU is YOUR RELIGION.

So. Here's the crayon version of one.

DATE
NAME

Mr. Employer,

It is my belief that I am a child of God. It is my belief I have to pray to him for guidance in all things as I am to only do his will. He has shown to me when I pray to him that I am not to put anything in my body which he has told me will make me unclean in his eyes. He has told me that the covid vaccine and testing swabs are not to be put in my body. He tells me this when I pray everyday.

Also he has told me I am made in his image and he does not want me to cover my face.

So I am letting you know that I cannot comply with these things based on my religion.

Considering I have worked all through this pandemic, for 2 years, and considering that OSHA will consider you compliant based on making me a religious accommodation, I see no reason why you would not make one for me.

Thank you.

My husband and I got our letter this week as well. I was wondering, would it work if I made my own business and asked my boss to hire as a "temp" worker? There has to be loop holes! If anyone else has ideas, I'd love to hear them.
 Quoting: Anonymous Coward 65908928

There are loop holes, I think, depending on how cool your boss and chain of command are.

I really want to read the regulations.

What about states that already outlawed mandates? What about companies with operations in different states? What about remote workers? What about subsidiaries smaller than 100? etc.

I'm confident my company will bend over backward to try to accommodate everyone, but it's unclear what that will actually look like.

Religious exemptions must be at the employer's discretion, right?
 Quoting: SugarSand

FedGov will build some incentive in, like $1 billion
fine for "invalid religious" exemptions so most employers
won't risk it.

Absolute crap that won't stand. THEY will have to UNDO the Civil Rights Act. Political suicide. Not happening.

They just hope you are ignorant. Which most are.

They just hope you don't love God and seek to follow him. Which most don't.

They hope when they pull you into a room to make you "explain" yourself you buckle under pressure instead of simply writing down all their questions and telling them you have to pray for guidance on answers.

If this moment in time does not wake you people up to the fact that the ONLY thing that is going to save you is the Lord I don't know what will.

The truth is most of you are lovers of self, ignorant of the law of the Lord, seek material comfort over spiritual gain and because of that 99% of you will just comply... eventually.

I say that not as a judgment but I say that because it is written in the word of God that such will be in these times.

A FEW of you, however, will view this moment as your awakening. God bless you all.

I have dropped several tools in this thread, even a sample crayon letter that you should make your own.

Start praying and realize that yes, your Lord, absolutely DID have his hand on the creation of this country, its founding documents, and many (not all), but many laws of it's land.

The Civil Rights Act was WRITTEN for THIS DAY, not for the 1960s as most would assume.

Your father was looking out for you all those years ago.

Re: Got the HR letter re:OSHA mandate this morning. Curious about how this is playing out for others.
They waited 'til the very last minute to send us the vaccination attestment form.

I remain unvaxxed, as does one other team member on a team of 6.

My company is great. I love it there. They are so good to their employees.

There's not a snowball's chance in hell I'd get the shot.

I have a feeling they will go out of their way to make sure they retain everyone they can, regardless of status.

I'm unclear as to how this applies to remote employees, because I'm practically remote as it is. I have an office, but I only go in once or twice a week.

I might be willing to get regular tests, as I think that they will go out of their way to make that convenient, perhaps on-site testing.

I'm a software developer and never have a problem finding jobs - recruiters find them for me ... and I'm not at all worried about a layoff if it comes to that. In my state you can collect unemployment insurance even if fired for cause.

So however it plays out I'll be fine.

I'd love to hear about others' experience.

I can't wait to see what happens February 9, which is the deadline to enforce the mandate.
 Quoting: SugarSand

I lost my software engineering job of 16.5 years (23 years in industry) on Nov. 1st for not getting vaccinated. I was the only one on my team not vaccinated.

We all had been working remote for over 2 years. Some of the other engineers on other teams that I was friends with tried the religious exemptions; they got denied and put on indefinite paid leave. 4 weeks into the leave they got termination letters from HR. They also don't get unemployment. I get it because it was considered I was not complying to company policy (to be vaccinated.)

I have not had any luck finding a new job as in some interviews they pop the vaxx question and I say "No." I am now looking for anything as I am burning through savings money fast.

I had expensive tastes like owning Maserati's etc. I was making OK money; way over 6 figures with all bennies including a pension.

Selling Maserati's, Alfa Romeo Stelvio maybe and a rare collector truck. I have lots of Gold as well but won't sell that just yet.

I stand up to tyranny as I am a Gulf war combat veteran and hate being blackmailed into something I don't want that stands against freedom. I didn't even want to attest to the vaxx question at my company; they had an HR Nazi meet with me and twist my arm. In the end, the day I got terminated I told them I had each of their names on a list for a future Nuremberg 2 trial. I told them I will volunteer my IT skills for free to bring these people to justice. I am sure they lost sleep over that which is what I intended.

I'm willing to be wrong but I'm pretty sure that nobody on this planet can mandate an experimental drug. It's the Nuremberg Code crime against humanity thing... and I don't think the tests can be mandated either, if they only have EUA by the FDA.

And you aren't testing until you find something better, you're testing until you find a job that doesn't require testing.

But you go ahead and just keep believing that by not getting the vax but by jumping through every other hoop that you're standing against the man. You aren't.

Please don't confuse words.

There is no "denial" or "approval" under the LAW. These are terms being issued by employers to gaslight you into think it some kind of employer discretion.

The actual terms are "accommodation made" or "cannot make accommodation due to undue hardship".

Please someone explain to me how if you have worked vax free during this entire pandemic, how now all of a sudden your unvaccinated status creates an "undue hardship"?

You can't. They can't.

Understand the law. Understand your rights.

Re: Got the HR letter re:OSHA mandate this morning. Curious about how this is playing out for others.
My sister works at Starbucks on the side, and she was given a mandate, I believe in the next couple of weeks. Get vaxxed or weekly testing, and it's implying that the employee is responsible for PAYING for the tests.

WTF. She ain't gettin jabbed, and she's stubborn as hell, so it should be fun to watch.

I don't communicate with HR unless I'm demanding more money.
