Anonymous Coward User ID: 78334071 United States 11/29/2021 07:43 PM Report Abusive Post Report Copyright Violation | What is fascinating (even though there is no official OSHA standing or support) is that OSHA suspended all actions for enforcement and implementation. OSHA, even on their website says it was suspended: [link to www.osha.gov (secure)] "On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA's COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) ("ETS"). The court ordered that OSHA "take no steps to implement or enforce" the ETS "until further court order." While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation." Details of above can be found here: [link to www.ca5.uscourts.gov (secure)] Ordinarily I would say they are operating defacto under "color of law" (since there is no actual law and OSHA cannot make law) but, in this case, I guess it would be Wells Fargo operating under "color of rule" since the OSHA "rule" was suspended as ordered by the Court. Thus, the force-feeding they are attempting to jam down everyone's throat in the US based on a "rule" with no enforcement or support by OSHA signals to me things are ripe for a lawsuit. Luckily, though, appears they are just trying to castrate their US based work force (whom may be required to take weekly cancerous Ethelyne Oxide coated nasal swabs unless someone on thier board rubs some brain cells together) since (despite "covid" being worldwide) employees in other countries do not have to follow the same edicts. Perhaps that is the plan? Shift more jobs out of the US to other countries under the "color of rule" so they have a boogeyman to point to? I would have thought a big bank would stick with active "rules" and "laws" (to avoid the publicity...particularly in this scenario when there is not even an active, enforceable OSHA "rule") but perhaps their board and legal are all just "yes" people. |
