Hi all - has Kyle been in jail all this time?

Can the judge protect the jury and Kyle by declaring this a mistrial (with prejudice?without prejudice?) whichever one that he cannot be retried?

That way, if the judge does not, that takes the blame off the jurors so that the mob wont go after them, and still gives the same outcome - that Kyle go free after this.

Will Kyle have to move somewhere else so that he doesn't get stalked by the enemy, since he is so recognized, i dont know if he will have a normal life after this.

Hi all - has Kyle been in jail all this time?

Can the judge protect the jury and Kyle by declaring this a mistrial (with prejudice?without prejudice?) whichever one that he cannot be retried?

Just a thought as we wait, everyone is focused on the first charge involving Rosenbaum but Kyle actually faces a more serious charge and I believe one in which he is in more jeopardy from is the Huber death.

The Rosenbaum charge is for reckless homicide and we have a lot of evidence Rosembaum posed a serious threat to Kyle.

The Huber death is actually "Intentional" homicide and carries a much stiffer sentence AND I can see where a jury might think Hubers actions did not rise to the same level as Rosenbaums. I don't agree with that logic, just saying I can see some jury people buying into it.

That is the one that actually concerns me the most...

As for using a gun, one shot in self defense during a dynamic exchange of assaults can not be construed as intentional homicide. If he followed up with one to the head of Huber, that would be different.

The longer it takes the more likely the jury is hung. It only takes one liberal juror that "feels" Rittenhouse is guilty to railroad him.

Mistrial with prejudice means it ends! And that could have occurred with all of Binger's misconduct but certainly when he intimidated the jury by pointing that gun at them and putting his finger on the trigger.

Mistrial with prejudice is entirely different than a hung jury. Only the Judge can proclaim mistrial, but one juror can cause a hung jury that can't reach a decision.
