Also, both you and your client could be liable for violating the accommodation laws under the ADA, and could get the pants sued off you both if you go the vaxed way or the highway route. Covid spread is not limited to employees, so the liability is really quite moot. I'd frankly just spine up and say this is how we roll, if your client doesn't like it, there's always another client. It's a 'CYA' situation for the clients and I gave them something they could use to cover their 'assets' in case of legal action. They did ask me about vax status again and I responded that we take the pandemic serious and the P&Ps were our companies active action plan. I wouldn't discuss vaccine status at all. Losing 3/4 of your business is still better than employees who have all their eggs in one basket. When an employee is forced to leave for whatever reason they lose 100%. I honestly suggest you ask your employees, tell them the position all of you face. You lose 70% revenue, you have to layoff people. You mandate, you will probably still lose some people but keep your revenue theoretically. But you know tides change and when you submit to something like that for a customer, they will make other unreasonable demands later. How well would you sleep at night forcing a vaccine on someone and they die or are forever jacked up? When I had a business, my top client placed an unreasonable demand on me that I found unacceptable. They knew they were a big part of my business (30%). I dropped them. I felt the pain, had to let 2 people go because of it. Took a year but I won other clients to make up the difference and rehired the 2 people I had let go. And that asshole client? They came back to me a year and a half later and said they reconsidered their position and would return to original agreed terms. Talk to a lawyer that specializes in contract law. Kind of like the CIA does with their contractors. Plausible deniability. Very important that you fully read and comprehend the fine print of their contract. Understand it fully as a layman. Look for loopholes. You will find them. There are always loopholes and work-arounds. Spitball the ten best potential work-arounds with your lawyer, and then restructure your company accordingly. Why would you have to take the shot? Remove yourself from payroll and pay yourself in dividends or other means. Embrace the cognitive dissonance. |
