Wow All I can say is you sir are in a place where you may be judged on your decision from here on out. I run my own business in a freedom to work state. We do business with a lot of people in this state as well as others…. All I can say is we have not been asked to do this or provide evidence of such…. As it is against the law………the only people who can ask for this info are customers who we work for that have the authority to ask for it per federal law and per job description where knowing if a person who has been vaccinated against a very specific issue because the area we are working in has known issues typically foreign countries… In fact in hospitals where a certain disease is being studied and yes there are hospitals with college university’s attached where dangerous disease are being studied. Anytime we are to work in these areas they still don’t ask for this info as it is policy to remove all of these substances from a room and the room be sterilized before we can begin work. Once work is complete the room is sterilized again and all substances are brought back into containment….. Never have we ever been asked for any medical info on any employee ever. Unless we are doing work in certain countries where these issues still persist. Like Africa for example. I don’t know what to tell you but something isn’t passing the smell test |

Either send only vaxed members of your team, or tell the client to go suck a lemon. Main thing, is calm down. You're reacting to something that hasn't happened yet. Also, both you and your client could be liable for violating the accommodation laws under the ADA, and could get the pants sued off you both if you go the vaxed way or the highway route. Covid spread is not limited to employees, so the liability is really quite moot. I'd frankly just spine up and say this is how we roll, if your client doesn't like it, there's always another client. Either you run your business or let your client run your business. The ADA prohibits discriminatory acts. When something becomes universal and includes all classes whether protected or not, it then falls outside of the protections provided by the act. They planned this one out very well. I cannot sue my clients, absolute kiss of death. I am concerned that some of my staff may file against me, some of this can break the corporate protection and fall on me personally. I am not a lawyer, but let's just say I am very well versed in the law. I do work in the field off law. If you have an employee who can not be vaxed for medical reasons, they are fully protected under the ADA, and employers MUST make reasonable accommodations. No universal anything changes this fundamental aspect of the law. |
