Adults, as long as they are competent to understand their decision, have the right to refuse medical treatment, even life-saving medical treatment, though a state may require clear and convincing evidence that a person wanted treatment ended before it allows termination. A state may restrict family members from terminating treatment for another, because this right belongs to each individual. The court has not extended this right to allow physician-assisted suicide. Each state is supposed to have a bit of autonomy but agree to be governed under a larger body if adequately represented. Time, greed, and lust for power has sullied the law and the legislature, and as you learned this November, votes shmotes. They do what they want with impunity. The end result, as America falls even faster than it did post 9-11, is going to be similar to swiss cheese. There will be random holes of freedom. Avoid the big cities, be flexible in work, and be ready to have to drastically change everything at a moment's notice. The best survival situation is probably either someone with a hella lot of property in the middle of nowhere and great security (at least 18 individuals willing to defend it), or a small, rednecky town (think Jericho series) willing to cut itself off and develop its own government and militia. The problem is, the more modern a town, the more Liberals who won't fare well without the government telling them what to do. You're going to have to know where the trouble people are and have a strong system in place to take care of them. Know your neighbors. A lot of people will move around really, really fast when shtf. People will go double up with family, and some will disappear completely. Have stashes. Have plans. Have paper maps. Period. You need to revisit some of the surviving Kosovo, Venezuela, etc. videos. |

It all depends on whose hands are down whose pants. Some judges will give away all of your rights based on his or her own opinions and feelings. Others try to keep with the simplicity of constitutional and legal right, though there are often small nuances and opinion-based decisions that go into the actual impact. The Supremacy Clause of the Constitution of the United States (Article VI, Clause 2), establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the "supreme Law of the Land", and thus take priority over any conflicting state laws. It can be fought and won! |
