Villages Florida - Resident says HOA in The Villages is suing her for displaying cross, lawn ornaments

She will lose. HOA is big business in the Villages. It's all right up front and signed on the dotted line before you move there. It's why I didn't move there.

How long did you live there since you know so much about it?
Nobody would make such a stupid remark if you didn't live there.

I heard it was a great place to live for people 55 and over. It's a beautiful community with 80,000 people.

I never understood why any rational person would buy property that was controlled by a HOA.

What’s the point of owning property if you don’t have any control over it? Why would anyone want other people telling them what to do with their own property?

Other than a nice US flag flying, I don't want to see shit on your yard. It makes the place feel tacky.



I suppose a garden knome is ok, but only because they come alive on a full moon.

I never lived in a HOA community, but they are usually very nice communities because they have rules for keeping the homes and lawn neat. No overgrown grass....no driveways with cars on lifts waiting to be repaired.....no boats hooked to trailers and parked on streets. I've seen that trash in some communities. Ugly.

Exactly, the solution is simple. You contractually signed yourself into it when buying, so contractually sign yourself out of it by selling!

Then you can go live wherever you want with people who also want to do whatever they want. Your 13' cross in the front yard will be next to a house with a wrecked out camaro in the front yard and you will be living in total personal freedom!

I'd imagine it's a direct sell to people that want strictly enforced normalcy for their neighborhood. Yea you can't exactly do what you want, but at the same time, that means you won't end up with a neighboring house that drives down the whole areas value with junk cars in the yard and gaudy or controversial ornaments.

If people choose to live in a HOA, it makes sense there shouldn't be religion based ornaments (unless stated during holidays etc). It invites trouble, as religious differences always do. I'd bet the woman in OPs post would complain if she saw a small Buddha ornament or other famous religious icons decorating neighboring houses if they weren't Christian symbols.

They broke pre-stated rules that anyone with common sense knows HOA will enforce and win everytime. The only one grasping is the woman in OPs post claiming she's a victim when really the only victim is the HOAs reputation due to deceit. Although personally I feel HOA are all shit, why defend someone acting on bad faith and playing a victim?

So about the only argument here is that the only people that would put things in their yards like yard gnomes crosses whatever have to be ignorant dumb hillbilly rednecks that got a broke down Camaro and don't cut the grass.

Now imagine if some standards were different say you weren't allowed to have any member of the opposite sex over to your house past a certain time if you were married.

Normally that is the case, but if they haven't been cracking down on others' lawn ornaments, then there is a case that they are going after her for spite and for religious reasons. She needs to counter-sue.

If you live in a rural place yes. However, you actually want standards in a neighborhood because it protects everyones home value.



Do you want your house to go down $40,000 in value because some asshole paints their house neon green? No.

HOAs protect you from the fact that anyone, of any persuasion, belief, or lifestyle can and has a Constitutional right to live next to you. yes, even sex offenders or worse those who think different than you politically. so you have to just find a good one, or go into where you know its not, and get elected thus restoring it.

its the one thing protecting you from your own misguided and ill-conceived ideas. otherwise. you enjoy. lets just have Islamic crescents in our neighborhoods and you can tell your kids what they are when they ask you "mommy what is that".

But it isn't just that, they:

Have a nice private little park and other things that people can use without having to deal with the general public.

Often have their own little security force that shoos away criminals.

Keep people's dogs from barking day and night

Keep people from running a noisy automobile paint shop out of their garage.

Keep people from selling dope out of their house with all sorts of seedy criminals coming and going.

Keep people from running a mini amazon distribution hub out of their garage with traffic coming and going at all hours.

Keep people's house in proper shape (like a rotted down porch or paint peeling off of the sides and broken windows)

Keep 17 people from living in a single family home along with their 17 cars jamming up the street.



So yes they do control people's behavior. Some people have to work and expect a certain peace level after they come home and try to go to bed. Or are retired and want some peace and quiet. An HOA is for them. If you want to make noise and do whatever you want then don't buy into one - the thing you don't seem to get is that it IS TOTALLY VOLUNTARY NOBODY FORCES ANYONE TO BE IN AN HOA WHY DO YOU CARE?

Me and my family went to Hawaii this past Christmas and we had to drive to The Villages to get a COVID test, and not only did we have to go all the way up there once, but we had to go up again the following morning because their Machine Broke

That isn't legally defensible in any HOA in any state you have to use a more realistic example.
