Mississippi Supreme Court Overturns Election, Bans Ballot Initiatives
In a 6-3 decision, the court ruled that because the state constitution mandates that ballot initiative petitioners must collect signatures from voters in five Mississippi congressional districts, while the state has only had four districts following the 2000 census, no ballot initiatives since 2000 are legally valid.

Since voters in the state can no longer directly weigh in under the ruling, the outdated constitutional provision cannot be changed unless Mississippi lawmakers decide to take on the issue. In addition, any other ballot initiatives that have passed in the 20 years since the districts changed would likely also be invalidated if challenged in court.

The medical marijuana ballot initiative was approved by 74 percent of Mississippi voters last November. At least 228,000 signatures were collected from what had been each of the five congressional districts prior to the 2000 census, the same process that the state advised be used for ballot initiatives in the years since.

Justice James Maxwell wrote a scathing dissent of Friday's decision, accusing the majority of "stepping completely outside of Mississippi law" with a legal "interpretation that not only amends but judicially kills Mississippi's citizen initiative process."

Court upholds life sentence for Mississippi man convicted of marijuana possession:

Allen Russell’s life sentence was upheld by a state appeals court Tuesday due to his “habitual offender” status from past run-ins with the law.

State law allows for a life sentence without parole if a person has spent a year in prison on two separate felonies, one of which must be a violent offense, according to the Associated Press/Report for America.

Police confiscated five bags from Russell when he was arrested in 2017, and confirmed that two of the bags contained 1.5 ounces of marijuana.

Russell did more than eight years in prison on two home burglary charges and spent another two years in the clink after a conviction for unlawful possession of a firearm, according to the Mississippi Court of Appeals ruling.

Re: Mississippi Supreme Court Overturns Election, Bans Ballot Initiatives
State Rep. Trey Lamar (R) said, “The language of Initiative 65 that would have gone into our constitution was not good for the people of Mississippi. I thank our Supreme Court for having the courage to rule according to the law and for protecting our citizens from the unintended consequences of Initiative 65. Now, we should craft a legitimate medical marijuana program that will truly help the people who would benefit from it without all of the unintended consequences that would have come with 65.”

Eleven initiatives have been filed targeting the 2022 ballot in Mississippi, including recreational marijuana legalization, Medicaid expansion, term limits, open primaries, and redistricting.

Two other initiatives (both in 2011) made it to the ballot and were approved since 2001 reapportionment. Initiative 27 was designed to require photo identification to vote. Initiative 31 prohibited the state of Mississippi and local governments from taking private property by eminent domain and then conveying it to other persons or businesses for a period of 10 years.
