Judge Finds Aggravating Factors In Chauvin Case, Paving Way For Longer Sentence
A Minnesota judge has found aggravating factors in Derek Chauvin's murder of George Floyd — a finding that dramatically increases the likelihood of a longer sentence.

Chauvin, a former Minneapolis police officer, was found guilty last month of second-degree unintentional murder, third-degree murder and second-degree manslaughter in the death of George Floyd in May 2020.

Chauvin sentencing pushed back to June 25

Sentencing for former Minneapolis police officer Derek Chauvin in George Floyd's killing has been pushed back to June 25, according to online court records.

Chauvin's June 16 hearing was reset by Hennepin County Judge Peter Cahill. A brief entry Thursday in the online court docket gave no reason, but court spokesperson Spenser Bickett said it was moved due a scheduling conflict.

The hearing time remains 1:30 p.m.

Was one of the factors that St. George wasn't able to get his Masters Degree cuz his life was cut short?

Its almost a year now, I'm surprised that there hasn't been a statue commissioned of St. George.

I have the impression that if it's discovered that fraud occurred in the trial, there could be an exception. Material fraudulent statements by a juror and an alternate juror, to get on the jury. But I doubt this judge will take the step of using such an exception, since he has always seemed to want this conviction.

The judge is scum. He should have changed the venue and definitely called a mistrial on several grounds - including the BLM supporter who was on jury duty and lied about his activities.

That is complete garbage!
If someone is murdered/manslaughtered, then yes that is an abuse of trust for a police officer - SO? Is that saying that police officers are MORE liable? Because they normally seem to be immune from anything. Do we have a special case of a different standard?

Particular cruelty? In a group? In the presence of children?
What about... while holding a ham sandwhich? Or in the presence of Horses. You can just tag things on so it seems.

I agree. Biden wants to keep this alive, to keep BLM feeling empowered and vengeful and as an excuse for more government actions, as long as possible. They'll never let this go, there will be one prosecution after another.

It would be cool if someone sprang Chauvin from jail and he disappeared. Because the goal is to humiliate him and make him a national symbol, sort of like MLK in reverse.

Oh no, they are already using it as an excuse to escalate. A simple example is the federal civil rights charges, which become much easier to convict on because the other conviction is in place and it can be assumed as a fact that he committed murder.

Apparently, the jury never got a chance to see the full video of the arrest---where Saint George started complaining that he could not breathe, and that he was dying, multiple times before he was put on the ground.

The conviction of Chauvin is one of the worst miscarriages of Justice I have seen. And now the "Judge" decides there were aggravating circumstances supposedly making it worse.

I don’t think that is true. The judge could and should declare a mistrial now due to the compromised juror. Chauvin hasn’t been convicted yet because sentencing hasn’t taken place. He is in the middle of the conviction process. I got this from a well informed legal source.

So you won't have an appellate decision saying "actually Chauvin did not murder Floyd because his knee was mainly on the back not the neck". That's a question of fact that an appeal will not touch (hope I'm wrong about this), and the only way to get that reconsidered is to have a new trial.

That aspect wouldn’t be an appeal because the prosecution expert medical witnesses all testified it was positional asphyxiation that killed Floyd - the combined elements of handcuffed behind back with arms pulled higher and tighter, chest pressed down hard against the hard street with Chauvin’s one knee on neck or shoulder, other knee on back, plus another cop kneeling on his back, so he could not draw a sufficient breath to allow blood to get to the brain, causing brain death and no further movement.
There was no testimony about only the knee on the neck causing death.

Cahill is not throwing anything out. It may be grounds for appeal but that's after sentencing.
