The state is up to some nasty tricks. They might very well want a mistrial so they can try again.

Carbon monoxide binds preferentially over oxygen to hemoglobin, creating carboxyhemoglobin that cannot bind oxygen. If 30% of hemoglobin binds carbon monoxide, then only 70% of hemoglobin can be saturated with oxygen. However, the pulse oximeter will read both hemoglobin saturations, producing an oxygen saturation reading of 100%, when in reality, the patient is severely hypoxemic. Pao2 can be misleading too, as it may be normal. Patients who may have been exposed to carbon monoxide must have carboxyhemoglobin levels measured with a co-oximeter.

These people have been nasty from day one. I've NEVER seen a prosecutor hide the truth and mislead a jury like this one has....

If I was on the jury I would acquit based upon the presentation of new evidence to discredit the defense witness when they knew they had it. That was poor work by the prosecution and they really slipped up there and lost a lot of credibility IMHO.

Judge may have gone to consult with a colleague. It seems to me the prosecution screwed up big time.

You should hear these buttholes on the HLN 'expert panel'. They are in full damage control. Precious.

I don't know man, maybe I've just been watching ABC and HLN too much and their propaganda is influencing me, but I think he's getting convicted of at least the bottom count.

State wanted to introduce new evidence they say they found last night. Judge ruled No, and told the State if they mentioned it, that he would declare Mistrial.

You're right the lady on ABC just did the same thing and just before going to a commercial she said how damaging this new testimony by Toobin was to the defense...
