In all fairness, he could've shot his eye out with that thing.

Pull anything on a cop resembling a weapon and you're going to get shot.

Honestly, if you do that anywhere with concealed carry and you can expect the same. I believe it would meet the criteria for lethal force in that one would believe that death or greivous injury could result from inaction. Further, I believe any reasonable person would do the same in the exact situation.
