I'm not a Constitutional Scholar, but I did stay at a Holiday Express Last Night! and Sum Ting is Wong..

My theory was that Biden was allowed to go through with the charade early, because Trump was STILL POTUS until noon - so during those 5 or 9 minutes, Joe completed the coup attempt with the swearing in, at which time he was abruptly arrested by the military, who took control of the country at exactly 12 noon.
