UPDATE: Federal Appeals Court upheld dismissal The suit is asking a federal judge to rule on the constitutionality of a clause in the electoral count act. The argument is that the act is unconstitutional as it goes against the 12th amendment. The act says members of congress vote, whereas the 12th amendment says each state delegation votes. Pence is named because he is the one who would have the authority to declare it a contested election as president of the senate who has oversight over the electoral count.
