Heroin, Cocaine, LSD, Methamphetamine, Oxycontin, etc.
The highest penalty is a $100 fine or a health assessment.

I think it's a step in the right direction. The war on drugs was an obvious failure.

After the Civil War, former Confederate states passed hasty laws which violated the 2nd Amendment as they restricted the rights African Amercans to own and bear firearms including former union soldiers.


This helps but also is problematic as acvording to the Tenth Amendment, where the US cinstitution is silent, then any federal law or SCOTUS decision then could unconstitutional and so could violate states rights.

Example homosexual marriage.

The US Cnstitution is silent on drug use with the nebulous situation of Prohibition amd its repeal as very bad overreach.

A case could be made that since the US Clnstitution is silent on drug use, then the Federal government cannot restrict states from allowing them as the undefined natural laws discussed in the Tenth Amendment.

The Feds could say it's a risk of interstate commerce. That has been their tactics in the past and it is a weak argument supposing that exporting across state lines would occur.

The US Constitution is entirely silent on marriage and thus the feds had no right to say what is or is not a marriage and restrict or expand this across all states. And they cannot force the issue that a state who recognizes homosexual marriage must be recognized through reciprocity laws.

If that is so, then no state can impose firearm laws when other states do not.

One state could entirely allow polygamy or other more extreme forms of marriage. While another could restrict marriage, and so people would move.

A form of secession would take place. Frankly this is what the Fiunding Fathers were trying to create where a state had an ethos and you relocated based on states rights policies.

So abortion might be allowed some places.

Already weapons laws GREATLY vary.

What the Bill of Rights does is restrict the FEDS from violating natural rights. Thus they cannot create unconstitutional restrictions.

Some could grow what they want and the feds could do nothing about it. It comes down to the originalists' interpretation and it being a sound legal decision juxtaposed against the Supremacy Clause.
