Obama balked on the idea of red flag confiscation and said the system in place was already adequate when push came to shove and the democratically controlled congress at the time apparently agreed. No red flag laws were ever enacted under a democratically controlled Senate because they understood the Constitution would have to be repealed before that would be a lawful move, something out of their political power to achieve.

On the other hand, Trump UNILATERALLY DECLARED we will have red flag laws with Federal law enforcement backing and anyone the government does not see as fit to have a gun can have it taken.

This undermines the second amendment on a fundamental level, and this is why a Constitutional scholar like Obama knew it was unlawful under the constitution.

.While I do not agree with legislation designed to limit the ownership of arms, it is hard to imagine a modern country where nuclear weapons and biological weapons were lawful for citizens to own and manufacture, so obviously some limitations are necessary. THAT BEING SAID, the question is where is the line drawn at a sane an constitutionally.
