Trump can still rescind DACA through Executive Order. Then the Supremes would either be forced to not rule on the (Trumps) EO thereby making it law, OR the EO would be upheld by the Supremes if they did hear the case (likely since it was enacted through EO by Obama).

This probably actually helps Trump to buy a little more time in the wake of the school shooting to get a deal on DACA. The school shooting ate up a week or more of the time for negotiating.

Supreme Court shouldn't technically rule on memo's, but then the question is, did they actually appeal to it? Instead of just pen an immediate withdrawal from a non legal memo. And ignore a non legal decision by the other judge?

Problem as I see it is that the appeal will go to the 9th circuit, who will delay over and over (years most likely) as they are so back-logged....

The choice to appeal to the 9th is no accidental.

Of course, Trump could just dissolve the 9th circuit, moving the judges to a couple new circuit courts and reduce the backlog (and pack the courts with conservative judges to dilute the liberal effects....

IMHO, this plan would be most effective after the mid-terms, especially if the Republicans can hold or make gains on the current majority.
