these are serious questions, and one should probably best proceed in such discussion by the book (i'm referring to you being student of law)
your question reminded me of the book of Bruno Leoni, Freedom and Law (which i hope you are familiar with)
also Kant explanation of private property,
and by default the system of deontic logic, which is a species of 2nd order logic and is axiomatized through possible world semantics, first introduced by Saul Kripke
so long story short, when a question is asked by one who is into the conceptual realm of such matters, i would never give 'authority' answers, but would gladly be up for a serious collaborative effort to come up together to that answer, by using state-of-the-art knowledge pertaining to that specific field of research :)
