Random Cop Check Point Checking Drivers License... Anyone Else???
So I live in a remote country area between two states.

I was returning home when I pulled up to a random cop check point (4:30pm est)...

Upon stopping I was asked for my license, which I handed over.

The officer then asked "where do I know you from, I know that I know you from somewhere"...

To which I replied: "well it wouldn't be from any trouble".

I only have speeding tickets on my record...

They then returned my license and I was free to leave.

I wanted to take out my phone and question them as to why they were performing illegal searches...

But..

Because I live on a state line all of my vehicles and insurance is still registered in the state I was born so I figured it might not be wise to give them a reason to hassle me.

I knew they could trip me up on never getting a license in my new state.

Has anyone else come across a random check point like this recently where they live?

I'm wondering if this is just random or if this is more "police state" conditioning???

The last one was all sheriffs out in the county but around here the local cops do them all the time.

I always ask if they're looking for someone. To which they almost always say it's a DUI checkpoint.

At 2:30 in the afternoon??? Really??

I got stopped not long ago, random checkpoint. I asked what was their probable cause, they said didnt need it. I told them whoever told them that ;lied to them. He said have a nice evening sir. Never asked for my licence

Yep, DUIs don't live by a clock, drunks out all times of the day...and I'll tell ya, if it's raining on a Friday during workday hours you better stay home, construction workers get paid thru/fri and if they can't work cause of rain, alot of them go to the bars.

How can a person be stopped and shaken down for their "papers" in America???

Like I said I live in a very small town, population less than 500 people.

A Dui check point perhaps... Just seems unlikely unless they have nothing else to do.

I did not like the feeling of the procedure at all...

Went through a roadblock about 2 months ago with one of my carpenters driving.. I was passenger, in my vehicle.. He had a marijuana pipe sitting on his lap when he pulled up to the Trooper.. Unbeknownst to me, or him apparently.. He handed the cop his license, all good.. Cop says, "Let me take a look at the tags and you'll be free to go".. He comes back to the window.. Says to Shane, "Is that a cigar in your lap?" He says, "Yes sir".. Cop says, "That's cool, never seen one like that before, can I see that a minute?" Shane says, "Here you go" and hands it to him.. At this point I am freaking the fuck out, because there was weed in the car and it's my damn car.. LOL So, the cop says, "Where do you put the tobacco in this thing?" Shane points to the screw off tip and says, "Right there" in a voice that says, "I am so fucked right now".. The cop goes to open it, stops then sniffs the tip.. And it was full of medical grade chronic.. So it smelled damn well like weed.. So after sniffing it, he hands it back to Shane and says, "You boys have a nice day".. Shane dropped the pipe into his lap and we drove away.. We just looked at each other like "WTF just happened?"

100% True story!

I don't like them either. It's a sign of the times. As bad as it is I'm fully guilty of not throwing a fit and going on some constitutional rant when stopped... And maybe that's the problem? Guys like me who are quite skilled at verbal conflict simply let it go so I'm not late getting home...

Checkpoints are voluntary. You do not have to proceed through them. Checkpoints in my State must state the purpose of the checkpoint, give advanced notice of the checkpoint and cannot pursue anyone attempting to avoid the checkpoint. Turn around! Their authorities are far more limited away from these checkpoints.

Maui Police posts up near my house occasionally and then I post up a few blocks away in order to give folks ample opportunity to avoid the checkpoint. The checkpoint usually breaks down after being informed that I am up the road warning people prior. I have never been harassed while holding up my sign.

I was actually conflicted with myself for not saying anything once I got home.

The realization that my insurance info and registration would have been an issue kept me quiet...

They did not offer a reason for the stop nor was there any signs posted...

I had an expired registration as well. I had already paid it but had yet to receive the new one in the mail.

I figured it would be an uphill battle with country cops with nothing to do...

Oh believe me when I say they do the same around here. But when their checkpoint doesn't conform with the law,that checkpoint is invalid and so is anything that transpires afterwards. Fruit of the poisonous tree.

Most folks won't read what their own State laws requires for checkpoints. They will just assume that it was legal and bend over for the judge's gavel to be shoved up their asses.

You are correct. The court ruled that the 4th Amendment has an exception for dui checkpoints. Just because some retard in a black dress added an exception to a plainly written right, does not give any law any validity.

Perhaps if you have ever even read the 4th Amendment, you would be so kind to show us all where that exception exists? Or just admit that you are a coward and would rather live serving on your knees.
