You said that eminent domain is in the Constitution. Both those claims are flat out wrong. Eminent domain existed long before the Constitution, but previously whenever .gov (monarchy or otherwise) wanted it, they just took it. The consitution provided restrictions by stating that .gov couldn't do that without compensating the owner of the property. I'm not trying to find any argument, I'm pointing out the serious flaws in yours. I'm not backtracking from anything, you are still digging deep for that argument so that I can respond and then you can respond back because it makes you feel like you haven't lost a bit of dignity when you were called out on making assumptions. Eminent Domain is in the constitution. It provides limitations that in effect, provide measures to properly enact a claim of Eminent Domain. Nobody is arguing that it didn't exist before. Now I think I will leave you with this as the last response unless you decide to actually address the issues being discussed and stop trying to shift it to something unrelated. According to the Fifth Amendment, eminent domain: Nor shall private property be taken for public use, without just compensation. Two things to note here: - it states public use. Trump is advocating that the courts use eminent domain to seize private land and then allow private developers to have it. - the only requirement in the amendment is "just compenation". That means they are only required to pay market value. Yes, some have gotten much more than market value, but not always. Too bad if your family land is priceless to you because you have owned it for five generations. It makes perfect sense for a wealthy real estate developer to advocate the use of eminent domain for the courts to seize privately owned land for the benefit or wealthy real estate developers, doesn't it? Municipalities very often form Consortiums with Developers in order to stimulate Business or upgrade a Neighborhood. Eminent Domain is a Sovereign Power of any Government. . |

There are no doubt other "federal agencies" managing other lands. I doubt if Trump, being an easterner, really knows or even understands what the issues are.
