Florida Police Stop 3 year old riding Big Wheel on highway

I read this article and had a few thoughts:
1) WTF is a 3 year old doing still wearing a diaper?
2) The kid was able to sneak out and escape on his Big Wheel while dad was "on the toilet". Sounds more like dad was high.
