Federal Civil Rights Commission Harshly Criticizes Homeland Security Dept.’s Treatment of Immigrant Detainees
9/20/15

Some of the findings of the commission were:

--The federal government’s treatment of detained immigrants may be inconsistent with the Fifth Amendment’s right not to be deprived of liberty without due process of law.

--The Commission finds that DHS may not be providing detainees with adequate avenues to report sexual assault or abuse. Moreover, the Commission finds that DHS may be inadequately addressing staff misconduct with regards to sexual assault and abuse.

--Certain privately owned detention facilities are not adhering to any set standard and are not providing detainees with nutritious food.

--Given the evidence presented in this report, and in light of the recent District Court ruling on DHS’s compliance with Flores Settlement, the Commission recommends that DHS act immediately to release families from detention.

Deferred Action for Childhood Arrivals (DACA)

USCIS publishes quarterly data on the number of DACA requests received, accepted, granted and denied. Since the inception of DACA* through the end of March 2015:

USCIS has received 1,175,689 DACA requests.
More than 71,000 of these requests were rejected and returned at the outset before being considered. Rejections may occur for a variety of reasons, such as the DACA request submitted is incomplete or without fee, or the requestor fails to meet the age guideline.
Of the 1,104,594 DACA requests accepted by USCIS, 748,789 were initial requests and 355,805 were renewal requests.
Of the 748,789 initial requests, USCIS approved 664,607 and denied 43,375; 40,807 remained pending.
Of the 355,805 renewal requests, USCIS approved 243,872, 414 have been denied, and 111,519 remain pending.
Denials may occur, for example, when a DACA requestor does not meet the continuous residence or education guidelines, was deemed to pose a threat to national security or public safety, or was otherwise deemed not to warrant deferred action based on the case-by-case review of each application.
These data indicate the volume of requests USCIS has received, the care with which requests are reviewed, and the number of individuals who have received deferred action. These statistics, however, do not illustrate the human face of DACA. Hundreds of thousands of DACA recipients are now able to come out of the shadows, attend school without fear, work to support themselves and their families, and contribute to their communities.

The White House Plan That Could Get Millions Of Immigrants To Vote

The White House citizenship effort is part of the president's Task Force on New Americans, which was created through his 2014 executive actions on immigration. But this particular outreach comes at a time when immigration has also again become a heated campaign topic in the GOP primary.

"Because the debate over immigration has gotten so polarized, and partisan ... there's a widening, deepening sense that immigrants should naturalize and should use the power of the vote to steer policy," Pastor said.

That seems to be what's happening.

Tara Raghuveer, the policy and advocacy director at the National Partnership for New Americans, one of the community partners working with the White House to promote citizenship, said her organization is encouraging people to become citizens "specifically in response to all the hate we've been seeing on a national stage about immigration recently."

Congressional leaders from around the nation met in Edinburg on Saturday for a roundtable discussion, in which several Rio Grande Valley organizations were able to voice their concerns on immigration issues.

Guards preside over the remote lock-down facilities, where detainees have little chance for contact with the outside world. Distressed mothers have staged multiple hunger strikes to protest conditions, one detainee attempted suicide, and lawyers have alleged that guards have sexually abused women. Human rights groups say the experience causes lasting trauma for families.

"Every single solitary right a parent has is taken away in detention — a mother can't discipline her child, feed her child, choose her child's medical care or education," Linda Brandmiller, an immigration attorney who has represented more than 100 mothers at Karnes, said. "The kids ask their mothers every day, 'Why are we here?' and they can't answer that fundamental question. My mothers have reported that their children's personalities have changed while detained."

Obama's Executive Actions on Immigration Are Ruled Unconstitutional

The U.S. Fifth Circuit Court of Appeals blocked a series of President Obama’s executive orders on immigration on Friday, frustrating the administration’s efforts to shield millions of undocumented immigrants from deportation and setting up a potential showdown at the U.S. Supreme Court.

A three-judge panel ruled against the Obama administration on a 2-1 vote in Texas v. United States, upholding a lower court’s injunction against two programs. Obama created one of the programs, called Deferred Action for Parents of Americans, or DAPA, and expanded another, called Deferred Action for Childhood Arrivals, or DACA in a unilateral effort to reshape the U.S. immigration system after the 2014 midterm elections. Texas and 26 other states sued the United States soon thereafter, in an attempt to halt the executive actions.

Appeals court rules against Obama immigration plan

NEW ORLEANS — President Barack Obama’s plan to protect from deportation an estimated 5 million people living in the United States illegally suffered another setback Monday in a ruling from a New Orleans-based federal appeals court.

In a 2-1 ruling, the 5th U.S. Circuit Court of Appeals upheld a Texas-based federal judge’s injunction blocking the administration’s immigration initiative.
