Sorry I haven't been on here in a while- I've just been so busy working to catch up from the past several years.

I'm really hoping someone can answer a question about something for me.

As a reminder I was offered a full-time bartending position at a new Native American Casino on Dec 19th.

I resigned my notice with my former part-time employer and even trained my replacement.

The casino opened on December 23rd. My last day with my former employer was two weeks from the time I resigned.

The first part of January I was persistent in contacting my new employer to see when I could start work.

I was fitted for uniforms, paid for my gaming licenses, attended orientation, etc.

Another week or so went by and finally I was called by one of 4 Food and beverage supervisors who said to me, "To be perfectly honest, we have WAy too many bartenders."

I was flabberghasted.

I asked if there might be another position available- I am qualified to do several jobs.

About another week passed and a manager called me to ask if I would like to begin bartending the following night.

I was ecstatic until I showed up and saw the bar they assigned to me.

It is over by the front desk and actually looks like an extension of the front desk.

Still, I showed up every shift with a smile on my face and served as little as one mixed drink or beer every night for 33 shifts.

I took home approximately $5-$7 a night in tips as opposed to the other bartenders at the main bar who were taking home over $150 a night.

It became apparent to me the only reason why they hired me to babysit that bar was because I'm not as lippy as some of those younger bartenders who flat-out refused to work it and naturally the higher-ups wanted the bar open.

The past few weeks bartenders have been dropping like flies and I questioned one of the nicer managers who assured me that I would be moving up to the better bar.

Two weeks ago they promoted a barback and last week they hired a young, tattooed bartender and you guessed it: They were immediately put on the good-paying shifts.

I asked to speak to the Food and Beverage Manager and it didn't go well.

I didn't lose my temper or anything but when he'd say something stupid like, "Well, until you can get your sales up....."

MY SALES UP?????

From the three months I stood at that bar in the corner that NO-ONE knew even existed?

There was a point in the conversation where he said, "Look. I've seen your credentials and read your references. I know you've worked the Las Vegas Strip, New Orleans french Quarter, and Key West (and I pulled in thousands of dollars of revenue on those shifts too) but frankly I'm not seeing that you're a good bartender.

Now THAT hurt!

And if it wasn't bad enough that he said it once he said it another three or four times.

NEVER in all of my years of managing employees would I have used insults such as that.

I was so upset I went to my doctor and asked if I could be prescribed some type of very mild anti-anxiety pill. This pissed me off enough because I've worked extremely more stressful situations than I encounter with this man and never relied on any drugs to help me get through them.

The doctor gave me .5 mg of Alprazolam.

Two days later when the F&B Manager came flying through the area in a rage (this time writing up another co-worker) I made a joke to her afterwards (YES! I KNOW THIS WAS MY DOWNFALL) that it's pretty sad when you feel like you need to take an anti-anxiety pill before you come to work.

Not two hours later two supervisors were at the door, told me to follow them to the office and told me they believed I was on some type of medication because my eyes were dilated.

I told them I had taken one of those Xanax and they drove me to a local drug testing facility.

The 10 panel test came back "Non-Negative" and they said they had to send it off to MedTox Labs up in St Paul, Mn and that it would probably take 4 days to get the results back.

I have spent a WEEK googling different laws regarding all of this and the main one I keep seeing is that the ROM at the Lab will call ME first with questions such as who my prescribing physician is, the pharmacy where I purchased it, etc. and that if I am taking this legally than I am cleared.

This morning I finally got ahold of them and the man says they don't release the results to the employee- only the employer. How in the HELL is this fair and how can I even begin to fight it?

Does anyone know anything about this?

I feel so angry right now about the time I invested in them -just now finally got my benefits and believe me- that's the main reason I took the job.

To make matters worse I keep hearing that the Native American tribes don't have to follow the same rules as other private companies.

I suppose some of you will yell at me but it's worth it if I can gt any advice on how to proceed from here.

I mean... do you want a decent job, or do you for some reason want to have one of THEIR good jobs to somehow prove a point to... who exactly?

Because you ain't never going to get the satisfaction you want working for those assholes. All they will GIVE you is misery.

Ream them up one side and down the other and go back for seconds, then move on.

- If you can get things back to normal at the job, start looking for something else.
- But it sounds like they don't like you.
- Working people think they have all sorts of rights and protections under the law, but they don't. Employers can treat people like shit and get away with it if you don't have a union.
- Are the other bartenders younger?
- If you can afford it, go to a different lab and get your own test, so that you can dispute the results your employer got.

Hi Miggy...sorry you're having such crap luck. It sounds to me like they're trying to get rid of you. Are they only putting younger employees into the better-paying positions? If so, they're probably using the dilated eye thing as a CYA. In case you sue for age discrimination, they can come back that you're a druggie and deserved to be fired.

Or maybe I'm way off base. Either way, I hope things get better for you.

I'm not trying to be rude, but are you a really slow worker?

They may have watched you and despite your experience, you may poke around too much. In that case, they wouldn't want you to work a busy bar in case you were unable to keep up with the orders.

The way they're going about this is just wrong though.

that .5 mg will make you fail drug test. get a written statement from your dr would be best hope. indian land does have its own laws.

This is an example why Labor Unions exist.

The Tribes do not have to follow U.S. Law, they operate under a Tribal Government for policy decisions.

The Tribes, like U.S. Government are highly politically charged entities FULL of petty Megalomaniac type personalities.

The ONLY way to combat this type of Employer is to make this situation a Public Record, and or a Media Event, if you can?

Even then you will be blacklisted from EVERY single Casino everywhere.

Be careful, there is not much you can do about this.

All I can say that there are plenty of bars/ restaurants in Tulsa and with good clientele. Cheery Street, IDL, South Tulsa. You could probably do better working there.

I hope you can find another job, Miggy. I'm so sorry that this one isn't working out well. You can hold on to it until you find a better job. I have similar problems and I'm not functioning very well at the moment myself, so I totally understand what you are going through with the anxiety issue.

I had a drug test when I was taking Fioricet for migraines. The lab tech nurse called me at home to ask who prescribed it, how long I had taken it, what for, etc. She pressured me to go for drug couseling (LOL I am no addict) but all this happened BEFORE they notified my employer. And when they did, they included the information I had given them that I was legally prescribed that med. The employer never said a word.

I don't know if there are different laws but that was in Florida about 10 years ago.

I hate that you're dealing with this, so sorry.

I have no idea the situation with your work, but suggest looking at the employee handbook, or guidelines, something like that and seeing if you're in violation of anything by taking RX medication at work. Perhaps theres a clause starting if such medication impares your ability to do your job you could be fired or given warning. I can't imagine it is against company rules to take RX meds as directed by DR unless specifically noted in the rules.

As for the placement youve been given, if I were you I'd invite my friends to the bar you work to draw up some more costumers. If you have no friends willing to visit, then you need to market yourself and your little bar by the reception desk better. Try dressing up in costume or pulling some kind of hook to get people to come to your little bar section.

Work what you got and show them the skills you have aquired through your experience. Can't you Tom Cruise cocktail it and throw stuff in the air? Don't give up, don't quit until you've got a new job or are fired. Don't let them get you down. You've been throw too much to let some young punks bully you out of there.

You made three huge mistakes and they are pretty silly to have made...

You quit your first job and trained your replacement before you were sure you even had a job...and you acually liked it.

2nd, you obviously didn't scope out the bars and other possible assignments prior to applying...you just assumed you'd meet all the qualifications for the type of bar you though you deserve to work at...(huge mistake)

3rd, you begged for any job, they gave you one, to be nice, and then instead of putting in some real work and hustling some tip money and showing these bosses that you are capable of selling drinks to people standing in the check in/check out line, you show up and talk shit to someone else and they ,unlike you, recognized that they needed to hustle for there tips at this bar and had you removed from the equation and probably took your 5 to 7 dollars in tips and is happier than you about it...


I would have taken that desk-bar spot and tried to turn it into the place to get a drink...I would have had people telling their friends to go see dude at the check in bar...he's a trip and makes killer drinks...tell him what you like and he kills it...etc...

instead you get yourself all caught up in drama looking like a drugged out complaining middle aged prude...who talks shit to boot...

See a pay stub some time there genie. A person on unemployment costs the former employer nothing. Unemployment insurance is paid by all during employment.

I am sorry you are so upset Miggy.

I don't think this job is worth becoming reliant on Xanax. It is not.
If this job is the cause of your need for this type of medication then find another one.

It sounds like they are trying to get rid of you and by that I mean- trying to force you to quit. Try to make them let you go so you can get unemployment while looking for a new job.

Pretty funny that an Indian Casino would give a shit about employees on medication. LOL!

Don't let this break your self confidence. It is not worth the disturbance in your peace to try to fight this or to work there at all.

If you have an Iggy's near you- they offer good benefits and have a nice bar and restaurant. Upper class clients who tip well. Maybe there are other restaurant's with bars in them like TGIF Fridays around? I have had friends work at these sorts of places and they made good money.

Good luck sweetie. Sometimes you just have to say fuck it.
