San Francisco Gives Gunowners 90 Days To Turn In Magazines

California Governor Jerry Brown may have vetoed a statewide ban on so-called assault rifles, but San Francisco officials have enacted a similar version of the bill locally – and the NRA is fighting back.

The city has a history of pushing the envelope on gun control. A total ban on handguns in 2005 was ultimately overturned by a state court in 2008. Smaller scale gun laws have been passed in the city since the court invalidated the handgun ban.

The new San Francisco high-capacity magazine ban was unanimously approved by the Board of Supervisors, making it illegal to sell guns with magazines with the ability to hold more than 10 rounds. The new San Francisco gun control law also requires that citizens who already own high-capacity magazines turn them in to the police department within 90 days.


What would you guys do? Would you turn them in? Should a LEO do his job? If you were LEO, would you obey what your bosses tell you?

For me, I would tell them to screw themselves. If they force their way into my home to force me to give up my magazines, I would show them how the magazines actually work.

The majority of people are too dumb, fat and lazy to care about their rights at the moment. Things will have to get bad before they take a serious look at what's going on. A city ordnance is only punishable by a fine . They also can not seize anything that the state law legally allows.

If state law says you can own it , then they can not take it.

They can only fine you once for having it in the city. If they try and fine you more then once or over and over for the same offense then its double jeopardy.

If a city tried to supersede state law , the city mangers can be removed by the state, The city is also subject to lose its municipality privileged.

just remember they can only fine you for owning it within the city limits.

Does the ordnance state owning , or harboring the item within the city limits?

The maximum penalty for any municipal code is a fine , and if they are applying code for legal by state items , then seizer is not an option.

Only by the power of state law "above a fine able offense" can they seize anything.
