roflPssst....wannna buy a big, green statue?

Never say anything to them. I once told a bill-collector, "it isn't our bill"...and started getting nasty letters saying that I "promised on the phone to pay all of my debt immediately" (it WASNT our debt) and threatening court action if I didn't keep my "promise".

Bill collectors are tied with phone solicitors for "scum of the Earth".

bill collectors have to be very hard hearted and have no scruples. scum might be too nice a word for them.
 Quoting: tinygreen

When bill collectors can't communicate with you, they may go to the court to find a way to get your money from bank accounts IF they KNOW.

If you notice your money withdrawn from your bank account because of an court order, you go to bank and close it. Bill collectors are FUCKED again.

Your bank will tell you why your bill collect took your money from your account.

When they don't know where your money is, they can't touch. An court order won't do a thing.

How do i know about this?? My friend told me about it.

I sympathized with this person. All she has to do is to send her husband's death certificate.

It happened to me once when I was in MA. After my mom passed away, her doctor office sent me her bill. I informed them that she passed away by sending them her death certificate. After that, their collection agency sent me her bill and i forwarded them my mom death certificate.

When her doctor office called me, i told them to look up her computer and they should know that she passed away in their freaking hospital.

I was so pissed that i told them that they needed to go to hell to collect the money because my mom wasn't alive.

Humanity was shitty.

Bank of America and all of the big banks are scum. Collection agencies are worse.

However death does not expunge debt. If you die owing money then your estate is responsible for the debt.

If you die broke and unmarried the debt may be written off but if you have an estate and/ or a spouse they are responsible for your debt.

About a year after my husband died I got a debt call from a company he had stopped paying before I ever met him and after checking with my lawyer I learned that in PA we were still responsible. My lawyer was able to negotiate it down to about 25% but I still had to pay it.

A couple of months after that I got a phone call from an agency trying to collect money from my ex-husband's dead uncle - they found me even thought I had moved, remarried etc. It was because my ex and his uncle had similar names but they will find you. I was able to explain that they were two different people and we hadn't been named in the will.

Re: WTF!!!!Bank of America 'called grieving widow 48 times a day to remind her of husband's debt'
Sometimes they don't even have the right person. We got harassed by a bill collector trying to collect on a credit card they said my husband owed. He has never had a credit card in his name, ever. After going around and around with this nasty person I told them they had to send me proof of the debt. They were checking the address they had on file... it was someone with the same name (spelled differently) who lived at a different address in town. I let loose on the motherfucker and took all of my frustration for the week out on his unlucky ass. No more calls.

good job!! give it right back to them. they do very little prep before calling people. you sucked the wind right out of them. good for you!

it's wrong to ask you to pay your husband's debt when you had nothing to do with his debt.

About real estate, if your husband let you have his real estate BEFORE he passed away, bill collectors can't touch it because it is not his.

It's tough to prove that your husband deliberately wanted to avoid his debt by letting you have his real estate WHEN he already died.

When a court and a bill collector don't know your actual address, there is nothing they can do.

You need to remember about "statue limitation". A bill collector can ask a court to do this or that in order to get X and Y from you for a SPECIFIZED number of YEARS. After that, the case is automatically CLOSED and a bill collector gives up. This specifized number of years could be 5,or 8, or 10 years.

You are free even though you may have hard time applying a credit card or loan BUT you still open another bank account.

good to know. i didn't know this.
 Quoting: tinygreen

It's about knowing the laws. Here is another thing for you to remember.

1- It's how and when you do it too because it's very important. For an example, don't let somebody else have your real estate or car 1 week or a few days BEFORE you file bankruptcy because it's easy to prove to the court that you deliberately avoid paying your debt.

Of course, you can live in the same house or drive the same car WITHOUT any problem even though your name doesn't appear on this real estate or car.

The court can't make this somebody to kick you out of the house because you own somebody money.

However, they had NO CASE IF YOU DID IT 1 OR 2 YEARS BEFORE you file bankruptcy.

2- If you don't want debt collectors get your money from bank accounts, you go to the bank to withdraw everything and close yours. You tell somebody whom you TRUST to open an account for you and deposit this money in this account and you can use it daily without any problem.

It worked beautifully every time because i changed my cell phone and home phone that way by complaining to phone companies about advertisement and comercial BS calls during my dinner when I was in MA.

The phone companies do it for FREE. Do you know that you can have your new home phone number every 4 or 5 years if you ask phone company???

Your old phone number will be inactive for nearly 1 year before somebody else can use it.
 Quoting: Anonymous Coward 1531747

that is good news.goodnews i changed my number because my ex'es keep calling me. but, i would definitely change it if i were being harrassed by bill collectors.
 Quoting: tinygreen

I know T-MOBILE allow you to have a new number after issuing you a number for 6 months.

Here is another way to deal bill collectors.

When they send you a bill, don't open it. Mail it back with a sentence " this person doesn't live here" or "wrong address' on an envelope.

My friend in CA did it and it worked. He did it 4 times before they stopped sending.

Furthermore, he also didn't pick up the phone when it rang. He answered the phone if he heard your voice on his answering machine.
 Quoting: Anonymous Coward 1531745

that is excellent advise!! i never answer my phone if i don't know the number. ever. i let it go to voicemail. i'm still getting calls for the person who had my number before me. i call the people that call for her and tell them she no long has this number. but i don't pick it up, i call them after.

sending the mail back is very smart. really good advise.
 Quoting: tinygreen

This does not work well in my country. The previous owner of my property never put in for a change of address to all of her creditors. So, everyday I check my mailbox and it is filled with outstanding bills for the previous owner. I got tired of returning the mail, so I started calling each of them to inform them that this person had not "actually lived" at this address for at least 2 years & to stop sending her mail to me. On one particular bill which she had run up to the tune of $1,500 for the Toll Highway & she was still using that highway....I called the Toll company & explained she did not live here and stop sending her bills to my address. They said that by law, they had to keep sending them to me, until she herself phoned them and put in for a change of address. This was like a years worth of bills they had sent my way, & this was how they operate. I was shocked. A few days ago, I got her driving licence renewal forms. I wrote across it....moved....return to sender.I don't understand why the police can't track her down.

I had a bad experience with BOA 9 years ago. I withdrew 10 dollars more than I should from my checking account. When i moved to a new location, my bankstatement was sent to an old address. When i went online to check balance, i saw -80 dollars on my account because of fees for overdraft. I went to BOA branch the next day and paid 80 dollars. BOA took my money and closed my account and REPORTED me to FAIRFAX for having -80 dollars on balance EVEN THOUGH I ALREADY PAID BOA.

Since that day, i haven't opened a checking account at any bank for 5 years because of FAIRFAX.

After 5 years, my record was automatically deleted from FAIRFAX's database and i can open an account at any bank.

I don't know how Canada Post Offices work. In US, you can fill a change address form or inform your mail man about previous owner, her mails will never be delivered to your house.

You should have ignored and they would stop sending them to you. People will never send you anything when they don't receive anything back from you for a long time.

It requires patience.

She needs to change her phone number so that boa won't bother her.

She can call ATT or Verizon or whoever her phone company is and tell them that she wants a new phone number because she is tired of all advertisement and commercial BS calls during her dinner.

They will do it for her in a heart beat because it requires by laws.

Bank of America is the worst bank ever!

yep they are awful. i had trouble with them during hurricane ike. we had no power at the bank, they couldn't make my payment and so boa slapped me with 29.9% interest when i had 4.9% before. i had never missed a payment or even been late. i had paid more if i had extra money, but it didn't matter one bit to them.

Never say anything to them. I once told a bill-collector, "it isn't our bill"...and started getting nasty letters saying that I "promised on the phone to pay all of my debt immediately" (it WASNT our debt) and threatening court action if I didn't keep my "promise".

Re: WTF!!!!Bank of America 'called grieving widow 48 times a day to remind her of husband's debt'
 Quoting: ohhappydays

that's terrible. is there no way to stop this? can you go to your local postal office and ask them to return all mail in this person's name to the sender?

the law that is used to send you her bills is insane. shocking to say the least.

Humanity was shitty.

even $1 can cause a mountain of trouble.

glad to know that 5 years is the extent of the database record. i'll bet that other firms keep them longer.

Re: WTF!!!!Bank of America 'called grieving widow 48 times a day to remind her of husband's debt'
She needs to change her phone number so that boa won't bother her.

She can call ATT or Verizon or whoever her phone company is and tell them that she wants a new phone number because she is tired of all advertisement and commercial BS calls during her dinner.

They will do it for her in a heart beat because it requires by laws.
 Quoting: Anonymous Coward 1531745

that is excellent advise. many people have had to do this. i've heard that there are ways to find your new number, but have not found any actual evidence of this.
 Quoting: tinygreen

It worked beautifully every time because i changed my cell phone and home phone that way by complaining to phone companies about advertisement and comercial BS calls during my dinner when I was in MA.

The phone companies do it for FREE. Do you know that you can have your new home phone number every 4 or 5 years if you ask phone company???

Your old phone number will be inactive for nearly 1 year before somebody else can use it.
 Quoting: Anonymous Coward 1531747

Yeah, and that somebody always turns out to be me, and now I got these fucking debt collection calls every damn day.

I don't even answer the phone unless I know who is calling.
 Quoting: Anonymous Coward 1520768

i understand. i have people calling for a woman who had my phone number also. i just don't answer or i call them back and tell them it's not me and to cease and desist.

some people really do need banks. they can only have their paychecks on direct deposit in a bank. i feel that is wrong, but that's what they do.
