Longton, according to the police report, was a convicted felon who had multiple warrants out for his arrest. He was a restricted person -- meaning he wasn't supposed to be carrying a handgun. The policy is there for a reason: if some hero employee does fight back, gets shot and crippled for life the store could be on the hook for 10s of millions of dollars in liability. Even more if the gunman escalates and kills/injures customers in the process. |

If he gets shot while trying to just hand over whatever the crook wants the store can claim in court that they took all "reasonable" precautions (as if security cameras and silent alarms prevent people from being robbed and shot) and that the store policy that employees should not resist under any circumstances is basically a "best practices" approach. As they took all "reasonable" precautions they would not be liable, at least in their minds. If they let their employees "get away with" defending themselves under any circumstances, then they fear a lawyer in a future case could point back at the incident as evidence that the store was not following the company guidelines and use it as leverage for a settlement or lawsuit. The store's more concerned with the potential cost of an employee defending themselves than they are in employee safety, but guilt also lies in the justice system for being so broken that robbers can sometimes sue successfully against their victims (Bodine v. Enterprise High School being the most famous example). |
