What happens when Social Security says you are not disabled? Well, first you do a reconsideration. (That takes up to 8 weeks to complete.) If they deny that then you go on to a Hearing...which can take up to 2 years to get a hearing date. After they deny that you go to an Appeals Council. Another 12 to 36 months to do that. And finally off to the Federal Court. Probably another year or so. So, if your really NOT disabled and you stop after the hearing part and start all over again, you will be forever in the system, getting free housing, medical, food and money along the way. How exactly do I know this? My neighbor does it. She lets the whole thing go through to a certain point and then just starts a whole new claim, but it allows her to stay on welfare forever, since the state can not force someone who is applying for Social Security to get a job. I also know it because I had the same thing happen to me. The difference being that I got approved for social security after the very first reconsideration. (And I only had the reconsideration cause I didn't show up the first time for my psych meeting.) I actually moved to a new state in between and the new state said that I had to get a job. Once I filled for the reconsideration, they were not allowed to force me to get a job. There is a huge difference between being disabled and getting social security and not being disabled and just using the system to your advantage. I think that if people apply for a reconsideration and get denied, people should have to go to the next level (Hearing) and if that is denied , the next level (Appeals Council) and if that is denied to the Federal Courts. And if the Federal Courts say you are not disabled, they can not apply again unless their medical history drastically changes. The problem is that they say that if you are denied for Social Security in the hearing phase that you can continue that claim to the next level and start a whole new claim!! And I thought that the people living off welfare that have a dozen children is worse....not anymore. At least the government is supporting children. This though, is crazy. Wait...what? You can quit work, claim to have a disability and apply for SS Disability payments, meanwhile collecting money? Do you have to pay for any of these hearings? I know there is a rule about having to have had a job in the last couple of years. I'm wondering because I know someone- an at home mom,has been quite ill for years. When her husband lost his job and they lost their house, no way she can collect SS because she wasn't working all along. That doesn't seem fair. They are being penalized for being middle class back then, now they are broke and there's no help for them. They can't get any kind of govt. help, just had to move in with relatives. Well, they do get food stamps. the husband finally took a crappy job way beneath his abilities. Relatives now want them out. I really don't see any chance of them getting govt. housing or anything like that. They are just part of the working poor now. Doesn't a doctor have to testify you have a disease? If so, why does SS argue it? Maybe someone claiming to have pain that really can't be proved? I don't get it. |

I know some people need the disability income and some only take it for the time they are out of work, it is not always a lifetime benefit (people forget that) Cant they tell who keeps repeating claims or what? My brother had 2 major heartattacks and filed. The first one he had at age 40, died for 3 minutes and was brought back. Luckily, he was training at a police academy at the time so they had a paramedic there. The second time he was able to get help from an abulance pretty quickly. He filed for disability for he could not even walk to his mailbox. He was able to get a heart transplant but felt that a younger person then him should have first dibs on one and that someone should not have to die for him to live. We had to fight with oklahoma red tape for 3 years to get his disability. They finally ok'd it one month after he passed away of his 3rd and final heart attack. The stress of worrying about bills, his medicine he couldn't afford, bills from doctors, his 3 children to raise, and trying to get some kind of income got to him. Even with his doctors writing letters to those people it still took 3 years. I finally wrote to the Governer's office, and several other DHS offices several times explaining everything. Not sure if this is what got it through or not but they wrote me back saying they would check into it and then it was ok'd but to late for him. People do work the system and should not for there are so many that do need it. |

Although if you get to the hearing part they suggest you have a lawyer and as I have heard you have to pay a certain percentage to that lawyer. But I never had to get a lawyer for my claim. Even if her husband is working she can still qualify for SSI. (Not SSDI) All she has to do is get her medical records from her doctor(s) and then go fill out the paper work. If they have questions as to her qualifying for SSI then they would send her to a new doctor. (Social Security pays for it.) Social Security argues just about everything if they see anything that might show that you are not disabled. Only 30% are approved the first time on the first claim. 20% are approved on reconsideration. Hope that helps your friend.
