Court Reform Starts Now


a. Court has NO METHODOLOGY to back up Burden of Proof. Interpreted. How is 50% arrived at from Preponderance of Evidence. Plaintiff/Defendant does not participate in scoring, at present. No written requirement. Amounts to Deception.

b. Court pamphlets inadequately communicate the entire range of ORDERS, MOTIONS ALLOWED to self represented. Amounts to a guessing game of what you can write.

c. Judge, replying to above request, 'I cannot give you legal advice' is equivalent to VOTING RIGHTS & POLL TAX LAW. Denial of EQUAL ACCESS to Courts. One of oldest Judge tricks in the book.

d. Making plaintiff/defendent go to Law Library to research old cases, DISCRIMINATES against Lay Citizens.

e. Old Court forms deliberately leave little or no room for actual writing. Shows PREJUDICE and BIAS against all Participants to restrict Testimony/Evidence.

f. Advice on dress codes for court, insufficient. 'How to Conduct a Case' education is required from the COURTS, not just linking to random articles.



Judge has ability to Legislate from the Bench.

Contact the Judge before your court date to rectify inadequacies, or present Orders at court. Appeal, if necessary.

SCORING METHOD


As a layman, I will take a first crack on a specific, gradable, case scoring method.

To prove a case, credible proof depends on the weight of evidence. I ask the Judge to evaluate, the evidence accordingly in respect to Believability, Persuasiveness. Sufficiency is included within the 2. Facts are presented within the 'Step' evidence.





BELIEVABILITY

1. A New Theory is composed Step by Step

For each individual chronological 'step'

-Describe supporting evidence?

-Describe 'character' involvement

-Support Extraordinary Claims with Extraordinary Evidence



2. The State's Theory is composed Step by Step (as for 1)





PERSUASIVENESS


3. Review each Theory separately, then together


b. Separate Review of Each Step of a Theory

-Is each step plausible?

-Does one step follow the other?

-Is each steps realistic?

-Can presented 'step' evidence, be carried out by the characters proposed?

-Do the characters have the experience?

-Do the characters have the qualifications?

-Can you disqualify a step, hence theory?


b. Separate Summary Theory Review


-Can the theory be implemented?

Can the theory be easily implemented?

-Is the theory logical?

-What do the characters have to gain?

-Do the characters have plausible motivation?


4. Theory vs Theory Evaluation


Is the version to be presented in court, in contrast to the theory presently assumed by the Government, as a whole, seem as concocted?

Are both versions presented, as a whole, capable of being as easily implementable?

Which version is more logical?

In which versions do the accused characters benefit, or gain more?

Do the characters have a higher degree of motivation, in one alternative than another?

Do the characters have a higher degree of means, in one alternative, or the other?

Do the characters have the job experience necessary to carry out the act, in both versions?

Do the characters perform up to expectations, in review?

Do the characters have the capability to alter or suppress evidence, in the presently accepted alternative?

Does a behavioral pattern preexist, which strengthens the new version?

Expert Witnesses


Others opinions of a character's 'state of mind', are speculative,
as the answer is truly unknown. A person's confession is also an opinion.

If the people are bringing the case,
lack of funds may prevent the hiring of an Expert.
This is discriminatory.

As Experts can usually be hired to support both sides,
we expect that lack of Expert testimony,
will not effect the scoring.

NEGOTIATIONS ON THE FOLLOWING WITH THE JUDGE


A. JUDGE must affirm in writing, that he will act as fairminded,
as other Judges, are considered as 'characters',
involved in the original outcome.

Alternatively, the Judiciary must come up with
alternative Judges, not possessing top secret clearances.


B. JUDGE must not have any Secret communications during the trial


C. OTHER involved Government agents,
must not have any Privileged Communications,
without disclosing them to the Public during the trial.


D. IF Jury trial is requested, Jury must use Scoring Method.
Jurors who disagree with majority,
must state specific reasons that are sufficient, or be disqualified.

Keeping this up for a minute, for Ventura debacle.

Our cases don't need Constitutional Rulings.
We'll go around, with above 'Ethics, Grading Strategy'

Let's obtain Enforcement, that doesn't fundamentally affect the 3-Branch Structure, as modifying GOV by a case, could be overriden.

We can seat a new Congress after, w/elections, pass new statutes, modify Constitution.
