"Senate Vote Gives Homeland Security Power to Waive All Law"
Statement of Robert Shull, Director of Regulatory Policy, OMB Watch
--
In passing the Iraq War Supplemental today, the Senate also gave the Secretary of Homeland Security the power to waive any and all law in the course of building roads and barriers along the U.S. borders -- without limit and with no checks and balances. The measure is part of the "REAL ID Act of 2005," the controversial immigration bill attached by the House as a rider to the Iraq war supplemental.

The consequence of this decision is that Congress has given one man a license to waive any law, for any reason or for no reason at all. Michael Chertoff, the Secretary of Homeland Security, now has the power to simply waive away laws that protect the environment, safeguard public health, ensure consumer and workplace safety, prevent unfair business practices, and ban discrimination -- at his sole and unreviewable discretion.

There is too much at stake to grant any government officials the power to waive all law. Immediately at stake, of course, are current environmental protections in the vicinity of the borders, but even more is at stake. These fences and roads will not build themselves -- they must be put in place by workers, who could lose all their workplace safety protections as well as their rights to collective bargaining or even overtime pay. This new power comes completely without limit; every law, from child labor to ethical contracting, can now be waived.

Congressional supporters of this measure would like us to believe that this measure means only that DHS can speed up completion of one small stretch of fence in the "Smuggler´s Gulch" area near San Diego. Nothing could be further from the truth. This measure is written so that Michael Chertoff will have unlimited authority to waive all law in the course of building roads and barriers and removing obstacles to the detection of illegal immigrants, and it applies anywhere in the vicinity of the borders. Earlier versions of this provision would have limited its scope just to environmental laws and just to Smuggler´s Gulch, but the version now passed by both houses of Congress applies everywhere along the borders and applies to all laws on the books.

We expect government officials to execute the law. No government agency should be above the laws that preserve America´s democracy. Congress has granted the Secretary of Homeland Security unbridled authority to act however he sees fit, without consequence, accountability, and any opportunity for judicial review.

In light of this, do we actually have any law in this country? Or is it all just force?

There is only the wannabe nazis and their force. It is They who destroyed Law and Order. It is They who are dismantling and trying to destroy Our Constitution.

Nearly every State has rejected the Patriot Acts. Now they just need to reel in the nazi stormtroopers who do not protect and serve The People. An eight month pregnant woman was recently tasered during a routine traffic stop. Children have been handcuffed in the back of police cars and tasered. People have been tasered to death.

Our Right To Protest that which we deem unfair has been abolished. Protest zones, razor wire, chain-link fencing, chemical attacks, clubbings, shootings with ´non-lethal´ pellets...

Congress´s TREASON against The People, who fork over hard earned money (if their job hasn´t been outsourced) every time the leeches vote themselves a pay raise or more perks to their elaborate retirement and health care plans. What W wants, W gets - no questions, no reading of the bills presented, only the BushCo Dog N Pony Productions. They hem and haw and put on their act, then they bend us over and shove it up our asses as if we were their toyboys at Bohemian Grove. 100 - 0 to give W Billions more for his ILLEGAL FOLLIES, with no end in sight.

Are these the acts of a government that cares for it´s people and country? Extreme Force against the People they have sworn an oath to protect? Extreme Force against the People who have been lied to, manipulated, fleeced, forced to fight illegal wars after being forced to witness the Mass Murders and TREASON on the morning of 911?

Don´t get me started on the ´election´ frauds.
Money taken from taxpayers for the benefit of ILLEGAL ALIENS. The Border Patrol ORDERED to STAND DOWN just as Bush/Cheney/Rice/Rumsfeld/Rove had our countries defenses stand down the morning of 911. Speaking of Rove, the Gay Sexcapades in the WH rooms, PEDOPHILIA in the WH rooms involving both Bush Sr. and W. Kidnapping, Torture, Lies, and MORE Lies. Dirty Tricks. The Dog N Pony Shows, like the one playing out over Bolton, and, the 911 ´independent investigating´ commitee. Endless PHONY ´terror´ alerts. On and ON.

Now the nazi bastards are planning on attacking Iran. They are out of control.

I´ve had frigging ENOUGH. Have YOU?

When "they" waive all law, then we will no longer be bound by thier laws either.
Actually, the Masons have been waiving the law for 3 centuries on this continent.

A totally lawless situation exists in this country thanks to these bastards.

You guys see them kill that guy L.A.. There was a car chase the guy jump out of the car with a gun he fell the gun flew out of his hand under a car the cops ran up and shot him numerous times. They {the cops] also unloaded over a hundred rounds into a guy that had pulled over after a chase. I don´t think that guys was even armed. Then cops shot each other in a shoot out when no one but cops had fired a shot. L A is about to have a melt down.

Stop and think for just a moment about why they would waive any laws. How could it possible be a "good thing"? They will only EVER waive any law to make prosecution and judgement of the common man much easier to accomplish and hide from the public.

In other words, this is not any kind of a God-send but rather a means to commit acts of tyrrany without prosecution against them.

The only Homeland Security we´ve really got is the security we provide for ourselves as evidenced by the Minutemen on our Southern Border. The government are all liars, theives, and traitors.

That FACT is proven by the lack of action by the Congress and Judiciary who have done little and nothing about the Bush regime even though there has amassed a mountain of evidence against them. Since this is the case, one can only assume that the Congress and Judiciary is guilty of Co-Conspiracy, Collusion, Fraud, and Treason.

No it is not like the Berlin Wall which prevented people from moving within their own country, East Berlin - West Berlin.

The Minutemen were preventing ILLEGAL ALIENS from ANOTHER country from crossing our border.

Also there was no WELFARE at the expense of taxpayers to support Berliner´s from either side of the wall as Bush has set up for ILLEGALS here. Dudya has taken money from the AMERICAN People and put it towards ILLEGAL ALIEN WELFARE.

In the interest in accuracy (I know..on this board, like trying to fight off a tsunami with a paper towel) the DHS only gets to bypass the judicial review process for one particular section of the border. That being said, this is TREMENDOUSLY bad law and it does set a frightening precident.

Re: "Senate Vote Gives Homeland Security Power to Waive All Law"
What gives the government right to make Homeland Security
above the law?

There are several indication of the possibility that
Homeland security may put millions of Americans in Concentration Camp called NEMA Camps. The information below has me concerned.

1) Homeland Security has issued an open purchase order for 1.6 billion rounds of ammunition.

2) Creation of many Fusion Centers .
Link to Locations:
[link to www.dhs.gov]

3) Creation of 600+ NEMA Camps.NAEMA Camp are managed by Homeland Security/Fusion Centers.
These camps resemble concentration camps or prisons. The one in Colorado is said to be able to house about 2 million people.

4) One NEMA camp has hundreds of thousands of coffins.
Why would you need coffins unless you have plans for them.

5) Canada Press had an article alleging " Is this a plan to implement Marshall Law?

6) The Us Government continually ignoring our Constitution.
a) Freedom of Speech
b) Right to bear arms

7) The Council of Governors is a group of 10 state governors of the United States. The Council was created by Executive Order 13528,[2] signed by President Barack Obama on January 11, 2010.
