Huckabee: New Law Will Open Arizona Up To A ‘Lawsuit Bonanza’

A few hours after President Obama called Arizona’s radical immigration bill an “irresponsible” and “misguided” measure that “threatens basic notions of fairness,” Gov. Jan Brewer (R-AZ) signed SB-1070 into law. Brewer claimed that her decision was made with Arizona’s best interest in mind and stated earlier this week that she would “do what I believe is the right thing so that everyone is treated fairly.” On Fox News, as Brewer signed the bill, former Gov. Mike Huckabee (R-AK) validated racial profiling concerns related to the implementation of the newly signed law and told host Neil Cavuto that it is going to open the state of Arizona up to a “plethora of lawsuits” that will prove “very, very costly”:

Here’s the dilemma: it’s going to open Arizona up to a plethora of lawsuits. You’ll have so many lawsuits that it will be very very costly to the state of Arizona. And here’s the real challenge. [...] This is a federal problem, the feds ought to be fixing this, they ought to be standing guard at the border, they ought to be enforcing the federal laws. When you have a state that is having to jump in and take on federal laws they don’t have the money resources for this, they don’t have the personnel for this, and the legal quandary they’re going to be in is going to be substantial. [...] It’s going to be one lawsuit bonanza.

Later in the interview, Huckabee added that “Hispanic Americans have the right to be unhappy about the fact that they might be pulled over.” “If I were being pulled over because I looked a certain way, I would be highly offended,” stated Huckabee. He also remarked that the “federal government has to do something to stop the hemorrhaging of illegal immigration over the border.”

My colleague Andrea has a great post up over at Think Progress about former Gov. Mike Huckabee (R-AR) airing his concerns over the recently passedArizonan immigration law, which basically not only authorizes but requires law enforcement officials to check the legal status of just about anyone they determine could be a likely undocumented immigrant.

The bill is quite radical, and the ACLU has warned that it will likely “exacerbate racial profiling,” because police officers may check the identification of brown-skinned people before all others (how else do you identify an undocumented immigrant without knowing anything else about them)?

This is where Huckabee comes in. Huckabee told Fox’s Neil Cavuto that he is worried about the law in three areas. One, it will open up the state to lawsuits as civil libertarians and those concerned with racial profiling will turn to litigation. Two, it takes immigration enforcement outside of the hands of the federal government, who really is responsible for enforcing our laws on this issue. Lastly, it may lead to the unfair targeting of Hispanics, many of whom are in the country legally and properly, and may even be analogous to past and current racial profiling against African Americans.

I was watching the exchange as it happened, and Fox host Neil Cavuto seemed pretty torn. It was as if he wanted to attack Huckabee, but because he is a major player in the GOP establishment, he held back. That’s precisely what makes Huckabee’s objections so important. No one anywhere near as prominent in the Republican Party has spoken out against this bill. Even John McCain, former immigration moderate and “maverick,” has endorsed this radical new law.

I had many colleagues who were surprised by Huckabee’s reaction. But I wasn’t.

A long time ago, back during the Presidential primaries (it really feels like forever, doesn’t it?), I remember a liberal friend of mine asking me about the race, and I told them that out of all of the people on the GOP side, I thought Huckabee was the most decent.

My friend, an avid feminist, reacted with scorn to my suggestion, and we didn’t see politically eye to eye for a while. I can understand her reaction. On social issues, Huckabee is extremely socially conservative, maybe even radical. Yet there’s something different about the governor compared to a lot of his GOP colleagues, and I think that’s basic compassion.

I remember when Huckabee was attacked and called “Tax Hike Mike” because he raised taxes in his state. When attacked, Huckabee didn’t really disavow the charge. Instead, he defended his tiny tax hikes because they supported programs for children — like health care and school lunch programs for poor kids. He was proud to be a compassionate person and to support the people of his state.

I know it’s not a very impressive bar to set, but it seems that compassion is lacking in the modern GOP, and seeing that from Huckabee, in a way, gives me hope that there is some sort of compassion in the Republicans’ leadership, and I only hope, and I say this with all seriousness, to the chagrin of many of my progressive friends, that if there is to continue to be a Republican Party in our country’s politics, we see a lot more like Mike Huckabee, and a lot less of the Randian, everyone-for-themselves society stuff that is pushed by so many other folks in his party.

When asked about Gov. Jan Brewer, Napolitano said her signing of the bill into law will have disastrous consequences:

Napolitano: She's gonna bankrupt the Republican Party and the state of Arizona. Look at what happened to the Republicans in California with the proposition --

Cavuto: What happens?

Napolitano: Ah, Hispanics -- who have a natural home in the Republican Party because they are socially conservative -- will flee in droves. She's also gonna bankrupt her state, because no insurance company will provide coverage for this. And for all the lawsuits that will happen -- for all the people that are wrongfully stopped -- her budget will be paying for it. Her budget will be paying the legal bills of the lawyers who sue on behalf of those that were stopped.

This will be a disaster for Arizona -- to say nothing of the fact that it's so unconstitutional that I predict a federal judge will prevent Arizona from enforcing it as soon as they attempt to do so. That will probably be tomorrow.

The new law, which will take effect in late July or early August, was cheered by many, including Maricopa County Sheriff Joe Arpaio, whose tough crackdowns have made him a hero in the anti-illegal immigration community. He said it gives him new authority to detain undocumented migrants who aren't accused of committing any other crimes.

"Now if we show they're illegal, we can actually arrest them and put them in our jails," Arpaio said.

Critics claim the bill will effectively encourage racial profiling. President Barack Obama branded it "misguided." Hispanic groups across the country tend to agree with Napolitano's assessment of the bill.

Immigrant advocates say the bill could worsen an already tenuous relationship between law enforcement and Hispanics in Arizona.

State Sen. Rebecca Rios, a Phoenix Democrat and fourth-generation Arizonan, said she's concerned about her 14-year-old son being harassed by police because of his brown skin, black hair and dark-brown eyes.

"I don't want my son or anyone else's son targeted simply because of their physical characteristics," Rios said. "There's no reason I should have to carry around any proof of citizenship, nor my son."

My mother is Hispanic and her relatives are often even more upset about illegal immigration than the general population of the U.S.. Rising crime and job loss to illegal aliens are serious issues for them, but resentment and suspicion against illegal immigrants is being cast towards Hispanic Americans who would otherwise be greeted with friendliness.

The illegal alien problem is tearing apart communities all across America and few Americans who have to deal with it directly daily are happy about amnesty talks.

It's obvious that we need to take control of our borders, especially during this war on terror, and especially as the anarchic and brutal Mexican criminal system is rapidly spilling into our country.

Huckabee knows that this is a death blow to Repub hopes in any future elections.

There will be NO racial profiling. It isn't allowed in the bill. NO ONE will be pulled over for "driving while brown".

It is AFTER someone is topped for breaking a law, that police can make inquiries about legal status, when a REASONABLE suspicion arises, such as the offender being unable to respond in English. It doesn't matter if they speak only Russian, or Korean or Spanish. If a person driving cannot speak any English, you can presume they can't read road signs either, such as "YIELD".

The Hispanic-Americans who are legal, and yet are whining about the POSSIBILITY of being profiled, are just pathetic, racist creeps playing the race card, and we've ALL had enough of that CRAP from Blacks.

For those of you who don't actually live in a state with a lot of illegal aliens, you have NO IDEA how pervasive the problem is.

Major crime issues, red-light running, drug dealing, people with prior arrest records who have already been deported, but come back AGAIN to molest or rape more children.

You garden variety, liberal hand-wringers probably live in a gated community in a Connecticut suburb.

We are trying to rid ourselves of illegal aliens here in the Southwest USA, not harass legal immigrants.

I agree with and support many of their planks but not to the extreme that many Libertarians take their cause.

* In 2005, Huckabee supported a bill that offered illegal immigrants in-state tuition rates and made them eligible for the same merit-based scholarships to Arkansas state colleges and universities as legal citizens. The bill would have violated federal law and was not enacted by the legislature.

* In 2005, he opposed a bill that denied some state benefits to illegals and required proof of citizenship to vote (patterned after Arizona’s Prop 200 that has been successful in curtailing illegal immigration in that state). In this story, Huckabee called the measure "un-American….inflammatory….race-baiting and demagoguery." He added that the bill "inflames those who are racist and bigots and makes them think there’s a real problem. But there’s not." He then singled out State Senator Jim Holt, also an openly professing Christian, saying, "I drink a different kind of Jesus juice."

* In 2005, Huckabee criticized federal agents for a recent crackdown on illegals, saying that it wasn’t fair to the innocent family members of those targeted in the operation. (No word on whether he also opposes raids on other law-breakers who might also have innocent family members affected by the fruits of their illegal activity.)

* In 2005, Huckabee promoted an "open door" policy on immigration as he addressed the League of United Latin American Citizens (LULAC) national convention in Little Rock. LULAC is a left-leaning group that opposes virtually all measures of immigration enforcement.

"He was an absolute disaster on immigration as governor. Every time there was any enforcement in his state, he took the side of the illegal aliens." - Roy Beck, president of NumbersUSA, a group that played a major role in rallying the phone calls that helped defeat this year's Senate immigration bill.

"I would hope he could be trusted to secure the borders, but given his track record in Arkansas, I don't see the conservative he has portrayed himself to be in Iowa." - Jake Files, a former Arkansas state representative and current chairman of the Sebastian County Republican Party
