[/quote] That aspect wouldn’t be an appeal because the prosecution expert medical witnesses all testified it was positional asphyxiation that killed Floyd - the combined elements of handcuffed behind back with arms pulled higher and tighter, chest pressed down hard against the hard street with Chauvin’s one knee on neck or shoulder, other knee on back, plus another cop kneeling on his back, so he could not draw a sufficient breath to allow blood to get to the brain, causing brain death and no further movement. A Minnesota judge has found aggravating factors in Derek Chauvin's murder of George Floyd — a finding that dramatically increases the likelihood of a longer sentence.
Chauvin, a former Minneapolis police officer, was found guilty last month of second-degree unintentional murder, third-degree murder and second-degree manslaughter in the death of George Floyd in May 2020.
