would refinance thru the govt using obama's hoisng plan?

i am underwater but i never missed a payment, i would be afraid to sign my house over to the govt for refinanacing, they say you have to sign a waiver of finacial hardship, they would watch everything you did for the rest of your life, you would never be free of them. i'll take the loss on my house instead.
