The Supreme Court did not uphold a ruling blocking President Trump’s efforts to wind down DACA
You’d think otherwise from reading the Hill’s social media feed that morning.

“Supreme Court upholds ruling that blocks Trump from ending DACA,” the newsroom tweeted.

The social media post even included a “BREAKING” hashtag.

That’d be a hell of a blow to the president’s agenda – if it were true.

What really happened is that the Supreme Court declined to hear the Trump administration’s appeal of a federal judge’s ruling that DACA remain in place. More specifically, the Supreme Court only announced it wouldn’t move ahead of the 9th Circuit, which has not finished hearing the case. The door is still open to the Supreme Court hearing the DACA appeal, but only after the 9th Circuit finishes.

“It is assumed the court of appeals will act expeditiously to decide this case,” the court said in a brief order.

The Supreme Court’s calendar is full until after June, so it likely won’t hear anything on DACA until at least October. That’s to say nothing of the decision, which likely won’t be announced until sometime next year.

Interestingly enough, the actual Hill report gets it right. The opening lines read, “The Supreme Court on Monday refused to hear the Trump administration's challenge to a lower court ruling temporarily blocking it from winding down the Obama-era Deferred Action for Childhood Arrivals (DACA) program.”

The report even adds: “The Supreme Court could still agree to hear the case after it is heard by the lower appeals court.”
